These Terms of Service ("Terms") govern your access to and use of the Championa platform ("Service"), provided by 90 PLUS Danışmanlık Sanayi ve Ticaret Limited Şirketi (trading as "Championa", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who you are contracting with

The Service is provided by 90 PLUS Danışmanlık Sanayi ve Ticaret Limited Şirketi, a company registered in Türkiye. References to "Championa" in these Terms refer to this entity.

2. Acceptance and authority

By using the Service you confirm that you are of legal age in your jurisdiction and, if you are using the Service on behalf of an organization, that you have authority to bind that organization to these Terms.

3. Account and accuracy

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.

4. Acceptable use

You must not misuse the Service. You agree not to:

use the Service for unlawful, fraudulent, or abusive purposes;
send spam, harassment, or content that infringes third-party rights;
upload malware or attempt to probe, scan, or breach the Service's security;
scrape, reverse engineer, or circumvent technical limits of the Service;
resell or redistribute the Service without our written permission.

5. Intellectual property

Championa and its licensors retain all rights, title, and interest in and to the Service, including all software, documentation, branding, and content we provide. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with your subscription plan and these Terms. You retain ownership of content you upload; you grant us a limited license to host and process it solely to provide the Service.

6. Payments, subscriptions, and taxes

Paid plans are billed in advance on a recurring basis (monthly or annually) until cancelled. Cancelling a paid plan stops future renewals; you retain access until the end of the current billing period. Upgrades take effect immediately on a prorated basis; downgrades take effect at the end of the current period.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. We offer a 14-day money-back guarantee on the first paid period of a new subscription, subject to carve-outs for renewals and substantial AI-credit usage. 7. Service availability

We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious violations of our policies. You may stop using the Service at any time by cancelling your subscription and closing your account. On termination, your right to use the Service ends; we may delete your content after a reasonable export window in line with our retention practices.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded under applicable law (such as fraud or death/personal injury caused by negligence).

10. Indemnity

You agree to indemnify and hold us harmless from third-party claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.

11. Changes to the Service or these Terms

We may update the Service and these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of Türkiye, without regard to its conflict-of-laws rules. Disputes will be resolved in the competent courts of Türkiye, except where mandatory consumer protection laws of your country of residence provide otherwise.
